Otherside Kodas come with a commercial license for original art, while KodaPendant images permit only personal use

Last updated -

Otherside Kodas have original character artwork their owners can commercialize under the Koda license. Images showing the KodaPendant visual update carry personal-use permissions only. That restriction leaves the original artwork’s license intact, so a pendant-bearing NFT can still have an original image eligible for commercial use under its license.

Commercial Koda designs can use licensed original art without reversing the KodaPendant’s permanent metadata update.

Koda ownership and image versions follow different rules

The Koda NFT, original character artwork, and pendant-bearing image each answer a different part of the ownership question. The token identifies the collectible. Its artwork license governs the owner’s permitted use of the original character image. The pendant version adds visual elements with narrower permissions. A single NFT can therefore have associated images carrying different usage rights, even though those images depict the same character.

Original art keeps its commercial license

The pendant update leaves the original Koda image’s license unchanged. The 2023 terms provided for the then-holder to receive a PNG of that original artwork from time to time. This retained artwork gives commercial work a base image distinct from the updated collectible’s display image.

Commercial permission still concerns the art associated with the owned Koda. It does not turn the entire collection’s artwork into a shared commercial library.

KodaPendant imagery stays within personal-use permissions

A Koda wearing the pendant can appear in a personal profile picture. The KodaPendant image version permits personal use only. The visual update also adds a celestial background and branded border. Choosing that artwork for a commercial design brings those restricted elements into the design, even when the owner also has permission to commercialize the original character.

Permanent metadata and editable files remain separate

The KodaPendant metadata change is permanent, while the image file used in an external design remains a separate, editable object. Keeping the original art does not reverse the update. It preserves the earlier image under its existing license.

Replacing an external design’s image does not remove the pendant trait from the token.

Which image belongs in a commercial Koda design?

The original artwork is the eligible version for this hypothetical commercial design, subject to the Koda license. A lawful Koda owner has both the original and KodaPendant images. The intended use and all other license conditions stay fixed; only the artwork version changes.

One draft uses the pendant-bearing image. Another uses the original character artwork. The pendant draft conflicts with its personal-use restriction. The original-art draft fits the commercial use allowed by the original art license, assuming all its other conditions are met.

Compare the exported design with the original image to confirm the design uses that artwork. An export filename or a preview of a different draft does not establish what the final design contains.

Changing the draft’s image leaves the NFT and its pendant metadata untouched. The file substitution remains reversible while the draft stays editable. The completed export establishes the chosen artwork, while commercial demand requires separate evidence.

Character licensing does not include Gucci branding

Commercial rights to a Koda character do not grant commercial use of the Gucci branding introduced by the pendant update. Purchasing a KodaPendant grants no commercial rights to use the Gucci logo. The same exclusion covers Gucci’s character font. Removing the character while keeping those brand elements does not place them under the original Koda art license.

Otherdeed Expanded and Vessel art keep separate terms

The 2023 asset framework distinguished Koda commercial art permissions from the separate personal-use licenses for Otherdeed Expanded and Vessel art. Receiving those NFTs through related claims did not combine their rights. A Koda’s license could not supply permission for commercial use of the other assets’ images. Any design combining assets needs the applicable permission for each component.

Owning the NFT differs from owning its copyright

A Koda’s commercial art license authorizes covered uses without making every related image or brand asset the owner’s property. Copyright ownership and permission to use a work are different legal relationships. The license governs use of the character art; the pendant purchase supplies no general transfer of Gucci or Yuga Labs intellectual property beyond expressly granted rights.

A downloaded PNG also does not prove lawful token ownership. Saving an image preserves a file, while eligibility to use it follows the applicable license.

Extracted traits need express permission

The pendant terms do not independently authorize owners to extract visual elements or traits for commercial use separate from their character artwork. They preserve any permissions the underlying Koda license expressly grants. A right to use the original character image therefore cannot serve as blanket permission for individual pendant components. The added pendant, background, and border remain subject to their applicable restrictions.

Later visual updates can carry their own permissions

Additional visual or trait updates can carry their own licenses, separate from permissions for the original Koda image. The 2023 framework contemplated personal-use or commercial-use terms for future updates. A commercial design using a later image needs permission covering that version and its added material.

Questions and answers about Otherside Kodas

Can I move the KodaPendant trait to another Koda I own?

The KodaPendant update cannot be transferred to a different Koda or Vessel. It stays attached to the NFT selected for the purchase. Ownership of another character does not move that trait or its associated image permissions. Using the original artwork in a design changes the chosen file, not the NFT carrying the pendant.

Do transparent KodaPendant images have broader commercial permissions?

A transparent-background KodaPendant image retains the pendant version’s personal-use restriction. Choosing the transparent version changes its presentation, while the pendant remains part of the updated artwork. A transparent background does not turn that version into the original character art covered by the commercial grant.

What did Ethereum gas pay for in the 2023 KodaPendant purchase?

Ethereum gas covered execution of the purchase transaction, separately from the KodaPendant price paid in ApeCoin. The purchase terms also made the buyer responsible for applicable taxes. Those payments did not broaden the artwork license or grant commercial rights to Gucci branding.

Does the Koda license cover every visual in an Otherside gameplay screenshot?

The original Koda art license does not automatically cover all the imagery in a gameplay screenshot. A scene can contain environments, other characters, and material governed by separate permissions. Including an owned Koda does not place those other elements under its art license. Commercial use must have a basis covering the additional material.

Are KodaPendant cosmetic options covered by the original artwork’s commercial license?

The 2023 KodaPendant terms placed cosmetic options under additional usage terms. Their descriptions included trail effects and a branded chat handle. Those entitlements did not themselves establish commercial rights to the visuals or branding they contained. Permission for original Koda art applies to the artwork covered by that license.
